Welcome to ScenarioSpace’s Terms of Service.
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the ScenarioSpace website, content and related services (together, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.
These Terms apply to anyone who accesses or uses the Platform (“you”), including visitors, registered facilitators, and participants in training sessions.
We may update these Terms from time to time. The latest version will always be available on the Platform, and your continued use of the Platform after any changes take effect constitutes your acceptance of the updated Terms.
2. About ScenarioSpace
ScenarioSpace is operated by Proxima Education Ltd ("we", "our", or "us"), a company registered in England and Wales (company number 13973914) with its registered office at Churchdown Chambers, Bordyke, Tonbridge, TN9 1NR.
ScenarioSpace provides an online platform that enables facilitators to create and deliver interactive training sessions for participants.
In these Terms, a "Content Partner" is an organisation or individual that provides or collaborates with us to develop training session content made available through the Platform.

3. Eligibility and Accounts
Eligibility
You must be at least 16 years old to create a ScenarioSpace account or use the Platform as a facilitator.
By using the Platform, you confirm that you have the legal capacity to agree to these Terms.
We reserve the right to refuse or remove access to the Platform where we reasonably consider it necessary to protect the Platform, its users or our legitimate interests.
Facilitator Accounts
To create and manage training sessions, you must register for a facilitator account using a valid email address.
You agree to provide accurate, current and complete information when creating your account and to keep your account information up to date.
You are responsible for maintaining the security of your account and for any activity carried out using it. Facilitator accounts are personal to the individual who created them and must not be shared with or used by any other person.
ScenarioSpace uses a passwordless sign-in process. You are responsible for keeping access to your email account secure, as anyone with access to your email may be able to access your ScenarioSpace account.
If you believe your account has been accessed without your permission, you must notify us as soon as reasonably possible.
Participants
Participants may join and take part in training sessions without creating a ScenarioSpace account.
Participants must comply with these Terms while using the Platform, including when submitting responses during a training session.
4. Acceptable Use
You agree to use the Platform lawfully, responsibly and in accordance with these Terms.
When using the Platform, you must not:
- use the Platform for any unlawful, fraudulent or unauthorised purpose;
- access, or attempt to access, any account, system or data that you are not authorised to use;
- interfere with, disrupt or compromise the security, operation or availability of the Platform, including by introducing viruses, malicious code or other harmful technology;
- use automated tools, such as bots, scripts or web scrapers, to access or extract data from the Platform without our prior written permission;
- impersonate another person or organisation, or misrepresent your identity or affiliation;
- copy, reproduce, distribute, modify or exploit any part of the Platform, or any training session content made available through it, except where permitted by law or with our prior written permission;
- collect, harvest or attempt to obtain personal information about other users or participants without their permission;
- submit, upload or share any content that is unlawful, defamatory, abusive, threatening, discriminatory, obscene, infringes another person's rights, or is otherwise inappropriate;
- submit personal data about yourself or any other person in participant responses or other free-text areas of the Platform; or
- use the Platform in any way that could compromise the privacy, safety or wellbeing of participants or other users.
Facilitators are responsible for ensuring that training sessions are conducted in an appropriate and professional manner and that participants are encouraged not to submit personal information during training sessions.
If we reasonably believe that you have breached these Terms or that your use of the Platform poses a risk to the Platform or its users, we may suspend or restrict your access to the Platform while we investigate the matter.
5. Training Sessions and Participant Responses
ScenarioSpace enables facilitators to create and deliver interactive training sessions. Participants may join a training session without creating an account.
Participants remain responsible for the content of any responses they submit and must ensure that those responses are lawful, respectful and comply with these Terms. Participants must not knowingly submit personal data about themselves or any other person in their responses or other free-text areas of the Platform.
Responses submitted during a training session may be made available to the facilitator running the session during and after the session and, where required by the design of the training session, to other participants taking part in the same session.
We may retain training sessions and participant responses in accordance with our Privacy Policy so that facilitators can access their training history.
Where training session content has been created by or in partnership with a Content Partner, participant responses may also be shared with that Content Partner, as described in our Privacy Policy.
Content Partners may use participant responses to improve training session content and may create, publish or share anonymous, aggregated insights derived from those responses.
Participant responses and other user-submitted content reflect the views of the individuals who submit them and do not necessarily reflect our views or those of any Content Partner.
While we are not under any obligation to monitor participant responses, we may review, remove or restrict access to responses or other content that we reasonably believe breaches these Terms, is unlawful, or could harm the Platform or its users.
6. Intellectual Property
All intellectual property rights in the Platform, including its software, design, branding, and training session content, are owned by, or licensed to us or our Content Partners. These rights are protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform solely for its intended purpose and in accordance with these Terms.
You must not copy, reproduce, modify, distribute, sell, licence or otherwise exploit any part of the Platform or its training session content except where permitted by law or with our prior written permission.
Participants retain ownership of any responses or other content they submit during a training session. By submitting content through the Platform, you confirm that you have the necessary rights to submit any content you provide through the Platform and that doing so does not infringe the rights of any other person.
By submitting responses or other content through the Platform, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, display and process that content only to the extent reasonably necessary to:
- operate and maintain the Platform;
- deliver and administer training sessions;
- make participant responses available to facilitators, other participants and Content Partners where the design of the training session or our Privacy Policy provides for this;
- improve the Platform and its training session content, including by analysing participant responses and creating anonymous, aggregated insights; and
- comply with our legal obligations and enforce these Terms.
This licence continues only for as long as we retain the content in accordance with our Privacy Policy and applicable law.
If you choose to provide us with feedback, suggestions or ideas relating to the Platform, you agree that we may use, modify and incorporate them into the Platform without restriction or obligation to compensate you.
7. Privacy
We process personal data in accordance with our Privacy Policy, which forms part of these Terms and explains what information we collect, how we use it, who we share it with, and your rights in relation to your personal data.
By using the Platform, you acknowledge that your personal data will be processed as described in our Privacy Policy.
8. Suspension and Termination
You may stop using the Platform at any time.
We reserve the right, at our sole discretion, to refuse, suspend, restrict or terminate access to the Platform or any part of it at any time, with or without notice and without being required to provide a reason. Without limiting that discretion, we may exercise this right for reasons including, but not limited to, where we reasonably believe that:
- you have breached these Terms;
- your use of the Platform is unlawful or may cause harm to the Platform, its users or any third party;
- it is necessary to protect the security, integrity or availability of the Platform; or
- we are required to do so for legal or regulatory reasons.
We may also suspend or restrict access to all or part of the Platform temporarily for maintenance, updates, security, technical or operational reasons.
Where reasonably practicable, we will give advance notice of planned interruptions to the Platform, but we may suspend access without notice where this is necessary to protect the Platform or its users.
Termination of your access to the Platform does not affect any rights or obligations that have accrued before termination or any provisions of these Terms that are intended to continue after termination.
To the extent permitted by law, we are not liable for any loss or damage arising solely from the suspension, restriction or termination of your access to the Platform where we act in accordance with these Terms.
9. Disclaimer and Limitation of Liability
The Platform and its training session content are provided to support professional learning and the development of professional judgement. They are provided for educational purposes only and should not be relied upon as legal, safeguarding or other professional advice.
You are responsible for how you use the Platform and for any decisions or actions you take based on the training session content or participant responses.
While we take reasonable care to provide accurate training session content and to keep the Platform available and up to date, it is provided on an "as is" and "as available" basis. We do not guarantee that the Platform will always be available, uninterrupted, secure or free from errors, or that any training session content will always be accurate, complete or suitable for your particular circumstances.
The Platform may contain links to third-party websites or resources for your convenience. We are not responsible for the content, availability or privacy practices of those websites, and accessing them is at your own risk.
To the fullest extent permitted by law, we exclude all implied warranties, representations and conditions relating to the Platform.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential or special loss, including any loss of profits, revenue, business, goodwill, opportunity or anticipated savings arising from your use of, or inability to use, the Platform. We are not responsible for failures caused by events beyond our reasonable control.
Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.
10. Changes to the Platform and these Terms
We may modify, suspend or discontinue any part of the Platform, temporarily or permanently, at any time and without liability, provided that nothing in this clause affects any rights you have under applicable law.
We may also update these Terms where necessary, including to reflect changes to the Platform, changes in the law or our business practices.
Where we make significant changes to these Terms, we will take reasonable steps to notify registered facilitators. The latest version will always be available on the Platform.
By continuing to use the Platform after any updated Terms take effect, you agree to be bound by those Terms.
11. Governing Law and Disputes
These Terms and any dispute or claim arising out of or in connection with them, or your use of the Platform, are governed by the laws of England and Wales.
If you have a concern or dispute about the Platform, we encourage you to contact us first so that we can try to resolve the matter informally.
If we are unable to resolve a dispute informally, it will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. General
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in full force and effect.
If we do not enforce a right under these Terms immediately, this does not mean that we have waived that right or that we cannot enforce it later.
We may transfer our rights and obligations under these Terms to another organisation as part of a merger, acquisition, sale of assets or other business reorganisation. If we do so, we will take reasonable steps to notify registered facilitators where appropriate.
You may not transfer your rights or obligations under these Terms to another person without our prior written consent.
Where these Terms require us to notify you, we may do so by email to registered facilitators or by publishing a notice on the Platform.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Platform.
